Jonathan supports clients in many industries, including the steel, pharmaceutical, energy, agriculture, and consumer products sectors. He regularly appears in administrative proceedings before the U.S. International Trade Commission (ITC), the Office of the U.S. Trade Representative (USTR), U.S. Customs and Border Protection (CBP) and the U.S. Department of Commerce (DOC), and he litigates appeals of those agencies’ decisions before the U.S. Court of Appeals for the Federal Circuit and the U.S. Court of International Trade (CIT). Jonathan also secures resolution of complex international disputes through arbitration before panels constituted pursuant to USMCA, NAFTA, the World Trade Organization, and the London Court of International Arbitration.
Jonathan also represents claimant investors and governments in investment arbitrations before the International Centre for Settlement of Investment Disputes (ICSID), as well as in ad hoc arbitration under the Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL). Jonathan regularly works with clients to develop strategies to avoid protracted and costly investment dispute settlement proceedings.
Jonathan is a Washington, D.C. native and is proud of his community service. He serves as the Chair of the Board of Trustees of the Thurgood Marshall Academy and as counsel to the court-appointed receiver for Options Public Charter School.
Representing the Government of Canada and the Canadian solar industry (comprising Canadian Solar, Heliene, and Silfab Solar) with respect to the Section 201 solar safeguard case.
Representing the Government of Ontario in the world's largest antidumping duty (AD) and countervailing duty (CVD) dispute pertaining to softwood lumber from Canada.
Representing Cardone Industries, and its subsidiary Tridonex, before the USTR and the U.S. Department of Labor in response to a USMCA Rapid Response Labor Mechanism Petition.
Advising Urenco, a global uranium enricher with the sole enrichment facility in the United States, on multiple international trade and investment matters, including the Russian Suspension Agreement.
Representing Kinder Morgan and Gulf Coast Express Pipeline with respect to its exclusion requests from the U.S. national security tariff on steel.
Representing M S International and Arizona Tile in multiple DOC and ITC proceedings and related CIT and Federal Circuit appeals pertaining to U.S. imports of quartz and other building materials.
Representing the U.S. Chamber of Commerce as amicus curiae in the Federal Circuit appeal pertaining to Proclamation 10101’s modifications of the solar safeguard tariff.
Representing Canadian Solar in the DOC AD/CVD circumvention investigations of solar panels from Thailand and Vietnam and in administrative reviews and related CIT and Federal Circuit appeals.
Represented Companhia Siderurgica Nacional in multiple DOC and ITC proceedings pertaining to the AD/CV orders on hot-rolled and cold-rolled steel from Brazil.
Represented Nestlé Waters North America in successful litigation challenging retaliatory Section 301 tariffs imposed by the USTR on European products.
Secured a complete victory at the ITC for Simcoa and Wacker in the Silicon Metal from Australia, Brazil, Kazakhstan, and Norway AD/CVD investigations.
Secured a complete victory for Bearing Art Corp. in the pending U.S. AD investigation of tapered roller bearings from Korea.
Successfully negotiated the settlement of an investment dispute prepared by a Japanese investor under the ICSID rules.
Successfully represented a multinational company in investor-state arbitration under the UNCITRAL rules.
Successfully represented Chrysler, Ford, General Motors, Honda, Nissan, and Toyota before the ITC and in subsequent CIT and Federal Circuit court appeals.
