Our German Corporate Litigation team regularly hosts webinars on different corporate litigation topics.

The Act on the Further Development of Restructuring and Insolvency Law ("SanInsFoG"), which came into force on January 1, 2021, is generally considered to be a "big hit" for restructuring practice. In addition to the introduction of a stabilization and restructuring framework for companies, it includes a number of changes and innovations with regard to the duties of business managers in crisis situations and the associated liability in the event of a breach of these duties.

In our webinar, we highlighted the new obligations and the increased, but in some cases also reduced, liability risks that business managers now have to face compared to the old legal situation. We also addressed the question of the extent to which D&O insurance covers such liability risks and presented the current case law of the Federal Supreme Court.
