Mark Orton is a senior associate in the Financial Services Regulatory practice. He advises a range of clients, including banks, asset managers, insurers, financial market infrastructures (FMIs), and FinTechs in relation to financial services regulation at both the UK and EU levels. Mark assists clients in creating commercial solutions to issues that arise in the changing regulatory landscape, including in areas such as market transparency, the conduct of business, and capital requirements. He also provides advice in relation to product terms and conditions and other types of financial services contracts, including custody agreements, investment management agreements, and financial services outsourcing contracts (including intra-group agreements put in place as part of corporate reorganizations).
Mark has extensive experience in the field of financial market infrastructure, having advised CCPs and investment exchanges on a number of issues, including applications for recognition in the UK and EU.
Mark has significant experience advising on the regulatory implications related to a wide range of digital assets and blockchain projects and helps clients to structure their offerings in a manner that is compliant with relevant regulatory requirements. This experience includes advice in relation to the tokenization of traditional financial instruments and regulated products, as well as advice on the regulatory implications of the provision of custody and other services in relation to ‘unregulated’ cryptoassets (such as lending and staking

Advising an overseas investment exchange on its establishment and regulatory recognition in the UK.
