Björn Handke focuses his practice on any kind of financial services, corporate and insolvency litigation matters. Based on his experience in representing large corporations, financial institutions and insolvency administrators in numerous court proceedings, some of them mass procedures, Björn understands the importance of an active legal project management system and alternative dispute resolution opportunities. This is done in order to keep the impact of a dispute on the client's daily business as small as possible.
During a one-year secondment to the legal department of Deutsche Börse AG, Björn strengthened his practical knowledge in the different areas of securities and derivatives trading, clearing and settlement business, as well as its national and international legal and regulatory framework. As a member of a team of in-house counsel, Björn helps to deal with several legal issues concerning, inter alia, the admission of a CCP under the "European Market Infrastructure Regulation", the regulatory required CCP's default management procedures, the development and market implementation of new derivatives, the securities settlement, custody system and collateral management.
Changing perspectives and taking the role of an in-house counsel as well as law firm client also helped him gain a better understanding of the clients' needs and the requirements that a lawyer should meet. Björn also regularly advises clients in disputes with regard to the valuation of companies, joint ventures, assets or shares, for example after a squeeze-out. This allows him to provide comprehensive advice covering the valuation itself as well as the coordination of professionals such as auditors, accountants and valuation professionals.
